Massachusetts cannabis regulations, including delivery operator license, officially in effect


The newest cannabis regulations in Massachusetts, approved by the Cannabis Control Commission in November, have been published in the Code of Massachusetts Regulations and are now in effect, officials said Friday afternoon.

The commission, which oversees the legal sale of cannabis in Massachusetts, filed the final guidelines with Massachusetts Secretary of the Commonwealth William Galvin last month. Eight public policy meetings, more than 250 public comments and two public hearings preceded the filing.


“The official promulgation of these regulations is the culmination of a lot of hard work and collaboration between Commissioners, staff, and the public,” said CCC Executive Director Shawn Collins. “Of course, promulgation is an important milestone in the regulatory process. We now begin the important process of implementation, which entails system updates, new and revised guidance documents, publishing FAQs and other educational resources, all of which are intended to make the regulations, our agency, and this industry more accessible.”

Among the new regulations is a cannabis delivery operator license type. The license allows for the wholesale purchase of cannabis items to be warehoused and then sold and delivered and has been lauded by supporters as an equitable and financially viable option.

However, opponents, including the Commonwealth Dispensary Association and some state lawmakers and municipal leaders, believe the license type violates the state Cannabis Control Commissions’ own statutes and will take money away from retailers and towns and cities. The CDA said last month that it was weighing legal or legislative action.

In addition to the delivery license that allows for the warehousing of products, there is also a courier option. Couriers will be licensed to deliver cannabis products directly to consumers or patients from a retailer. Couriers can charge fees but cannot sell, process, store or repackage goods.


For three years, the license types will be available only to economic empowerment or social equity applicants, programs that seek to benefit people who were disproportionately affected by the War on Drugs.

The Commission’s next monthly public meeting is scheduled for Jan. 14.
